The IRCd you use allows an invite to override bans. Either remove that persons access or make the requirement for ChanServ invites higher.

The invites override the bans.

Well if you are banning a user from a channel why give them access?

Though you could avoid it by setting invite to a higher level:

/msg chanserv level #channel set invite 4

I know the higher level! I can not otherwise regulate this?

Don't give them level 3 access?

It's pretty simple really. If they have the power to invite themselves they can override bans.
